These Terms and Conditions govern your access to and participation in programmes offered by Fathomwork Sdn. Bhd. ("Fathomwork", "we", "us"). By enrolling in a programme or submitting an enquiry, you agree to be bound by these terms. Please read them before proceeding.
1. Definitions
- "Programme" — any of the management programmes offered by Fathomwork, including Foundations of Management Practice, Marketing and Customer Strategy, and the Advanced Management Programme.
- "Participant" — any individual who has enrolled in a Programme.
- "Content" — all teaching materials, session recordings, exercises, toolkits, and other materials provided by Fathomwork in connection with a Programme.
- "Agreement" — these Terms and Conditions as updated from time to time.
2. Acceptance of terms
By submitting an enrolment form or completing payment, you confirm that you are at least 18 years of age, have read and understood these terms, and have the legal capacity to enter into a binding agreement. If you are enrolling on behalf of an employer, you confirm that you have authority to do so.
3. Programme description and availability
Fathomwork offers management education programmes for working professionals, delivered through live online sessions and in-person residentials (Advanced Management Programme only) in Kuala Lumpur, Malaysia. Programmes are available to participants regardless of their location, subject to scheduling compatibility. Fathomwork reserves the right to modify programme content, schedule, or format where reasonably necessary. Material changes will be communicated to enrolled participants.
4. Enrolment and accounts
Enrolment is confirmed when full payment or an agreed instalment is received and you receive written confirmation from Fathomwork. You are responsible for:
- Providing accurate personal information at the time of enrolment
- Maintaining the confidentiality of any access credentials provided
- Ensuring that the email address you provide is monitored, as programme communications are sent there
5. Participant responsibilities
As a participant, you agree to:
- Engage with sessions, practice tasks, and assessments in good faith
- Submit your own original work in all assessments and practice task accounts
- Treat faculty, staff, and fellow participants with respect in all interactions
- Not share access credentials, session recordings, or programme materials with people who are not enrolled participants
- Not use programme materials for commercial purposes outside your own professional development
Fathomwork may terminate your participation if these responsibilities are not met, without obligation to refund fees.
6. Intellectual property
All Content provided by Fathomwork in connection with a Programme remains the property of Fathomwork or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use Content for your own professional development during and after the programme. You may not reproduce, distribute, or create derivative works from Content without prior written consent from Fathomwork.
Work you submit as part of a Programme — practice task accounts, assessments, final projects — remains your intellectual property. You grant Fathomwork a limited licence to use your submissions for assessment and programme improvement purposes, anonymised where used for the latter.
7. Fees and payment
Programme fees are:
- Foundations of Management Practice: RM 540
- Marketing and Customer Strategy: RM 2,080
- Advanced Management Programme: RM 4,330
All fees are in Malaysian Ringgit (MYR). Instalment arrangements are available for the Marketing and Advanced programmes — contact us to arrange. Payment must be completed before your cohort start date unless otherwise agreed in writing. Fathomwork can provide documentation to support HRDF claims and employer sponsorship arrangements.
8. Deferral and cancellation
We handle deferrals and cancellations as follows:
- Deferral: If you cannot complete your cohort due to professional or personal circumstances, you may request a deferral to the next cohort. Deferrals are handled individually. We do not apply a standard financial penalty for deferral requests.
- Cancellation before start: If you cancel more than 14 days before your cohort start date, you will receive a refund of fees paid less an administration fee of RM 150. Cancellations within 14 days of start are not eligible for a refund, but you may request a deferral instead.
- Fathomwork cancellation: If we cancel a cohort for any reason, enrolled participants will receive a full refund or the option to transfer to the next cohort.
9. Programme completion and completion records
Completion records are issued only on completion of all required components of the programme — sessions attended, practice tasks submitted, and assessments completed. Records state the programme name, duration, content areas, and assessment outcomes. They describe what was done and are not representations of competency or professional qualification. Fathomwork does not represent that completion of any programme satisfies requirements for any professional licence or regulatory body.
10. Disclaimers
Programmes are provided for professional development and educational purposes. Fathomwork does not represent that participation will produce specific career outcomes. Content is provided to support participants' own thinking and judgement — it does not constitute legal, financial, or professional advice. Participants are responsible for decisions they make in their professional roles.
11. Limitation of liability
To the extent permitted by Malaysian law, Fathomwork's aggregate liability to you in connection with a Programme is limited to the fees you paid for that Programme. We are not liable for indirect or consequential losses, loss of business or revenue, or any matter beyond our reasonable control.
12. Indemnification
You agree to indemnify Fathomwork against any claims, losses, or expenses arising from your breach of these terms or from your misuse of programme materials or Content.
13. Termination
Fathomwork may suspend or terminate your access to a programme if you breach these terms in a material way. You may withdraw from a programme at any time, subject to the cancellation terms in section 8. Provisions relating to intellectual property, disclaimers, limitation of liability, and dispute resolution survive any termination.
14. Governing law and disputes
These terms are governed by the laws of Malaysia. Any dispute arising from or related to these terms or a programme will be subject to the exclusive jurisdiction of the courts of Malaysia. We encourage parties to attempt informal resolution before commencing legal proceedings — contact [email protected] to initiate that process.
15. General
- Entire agreement: These terms and any written enrolment confirmation constitute the entire agreement between you and Fathomwork for programme participation.
- Severability: If any provision of these terms is found unenforceable, the remaining provisions continue in effect.
- Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your enrolment or rights under these terms without our written consent.
16. Changes to these terms
We may update these terms from time to time. Updated terms will be posted on this page with a new effective date. For enrolled participants, we will provide notice by email of material changes. Continued participation after the effective date of updated terms constitutes acceptance.
